Terms of Service

These Terms of Service govern your use of Class8Access. By checking the agreement box during signup, creating an account, or using the service, you agree to be bound by these terms.
1. The Service
Class8Access ("we," "us," "the Service") provides truck sales representatives ("Rep," "you") with a hosted personal sales page displaying your name, contact information, and inventory, along with tools to convert dealer inventory data into a format usable by that page (the "Inventory Converter"). The Service is offered on a subscription basis as described on our pricing page.
2. Eligibility & Accounts
You must be authorized by your dealership or employer to represent the inventory, photos, pricing, and contact details displayed on your page. You are responsible for the accuracy of the information you provide us and for keeping your account credentials confidential.
3. Subscription, Billing & Cancellation
Subscription pricing (including any "founding member" rate) is displayed at signup. Subscriptions renew automatically each billing period until cancelled. You may cancel at any time; cancellation takes effect at the end of the current billing period, and we do not provide partial-period refunds except where required by law.
4. Inventory Data & Third-Party Sources
Your page displays inventory data and photos that you supply or that are derived from third-party sources you point us to, including but not limited to your dealership's DMS, TruckPaper, Commercial Truck Trader, or Sandhills Global exports. We do not independently verify the accuracy, availability, or licensing of this data or these images, and we are not responsible for errors, omissions, or delays originating from those third-party sources. Photo links sourced from a dealer's inventory CDN may expire when the dealer's own listings change; refreshing your inventory data is your responsibility.
5. Ownership of Content
You and/or your dealership retain all ownership rights in the inventory data, photos, and dealership branding you provide. By providing it, you grant Class8Access a limited license to host, cache, and display that content solely to operate your page. You represent that you have the right to grant this license.
6. Lead Data
Contact forms on your page collect information from prospective buyers (name, phone, email, and message) and deliver it directly to you. You are solely responsible for how you use, store, and respond to this lead data, and for complying with applicable telemarketing, email, and privacy laws (such as TCPA and CAN-SPAM) in your own follow-up communications.
7. Acceptable Use
- You will not use the Service to list vehicles you are not authorized to sell, or to publish false, misleading, or discriminatory content.
- You will not attempt to resell, sublicense, or use the Service to build a competing product.
- You will not misuse, scrape, or overload the Service or attempt to access another Rep's account or data.
8. No Guarantee of Results
Class8Access is a marketing and hosting tool. We do not guarantee any specific number of leads, page views, or sales resulting from your use of the Service.
9. Service Availability & Disclaimer of Warranties
The Service is provided "as is" and "as available," without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee the Service will be uninterrupted, error-free, or secure.
10. Limitation of Liability
To the maximum extent permitted by law, Class8Access and its owners will not be liable for indirect, incidental, special, or consequential damages, or for lost profits or lost leads, arising from your use of the Service. Our total liability for any claim relating to the Service will not exceed the amount you paid us in the three months preceding the claim.
11. Termination
We may suspend or terminate your account for violation of these terms, non-payment, or misuse of the Service. You may cancel your account at any time as described in Section 3.
12. Changes to These Terms
We may update these terms from time to time. Continued use of the Service after changes take effect constitutes acceptance of the revised terms. Material changes will be noted with an updated "Last updated" date above.
13. Governing Law
These terms are governed by the laws of the Commonwealth of Kentucky, without regard to conflict-of-law principles, unless otherwise required by applicable law.
